© Copyright Policy
Copyright comes into place automatically when we produce
original creative work: this work could be an identity, brand,
design, strapline, website (in fact any creative or innovative
item) so long as is ‘new and original’. Copyright
ownership also allows us the protection of creative material once
it becomes publicly available. As the original creator, we retain
the right to preserve the copyright and protect how the work is
used, and how broadly it is to be used.
The client may request in writing that copyright is licensed
or assigned to the client, either in advance or retrospectively,
for an agreed appropriate remuneration. Where it is agreed that
copyright is to be licensed or assigned, and even when it is included
in an original agreement, this is deemed to cover the creative
work in its original form only and it is not to be used in any
other form other than that which it was agreed and paid for.
The client therefore accepts that it may not take any original
design or innovative works produced by Dynamics Media and subsequently
alter the design, or engage another firm to alter the design,
without prior reference and payment to Dynamics Media as the originator.

Other Considerations
In some cases, design and development projects utilise
modular programs or systems which are owned by a 3rd party (e.g.
Microsoft). Therefore ownership of these parts of the solution
remain theirs.
For example, when buying a copy of Microsoft Word the purchaser
may use it however much they want to, or not use it, or even throw
it away - the choice is theirs. However, although they paid to
own it, they do not own the source code that
produced it, and therefore cannot rename, edit it, or sell it
on as your own without breaching the IPR.
In all cases, projects where IPR is requested would need an agreement
or option to own in place prior to development. Please note Dynamics
can also organise the registering of trademarks.
